Terms of Service

These Terms of Service ("Terms") govern your use of Agent Analytics, operated by Agent Analytics ("we", "us", "our"). By using our service, you agree to these Terms.

1. The Service

Agent Analytics provides an API-first analytics platform designed for AI agents. The service includes event tracking, data querying, and a web dashboard. We offer both a free tier and paid plans.

2. Accounts

You must authenticate via GitHub or Google to create an account. You are responsible for maintaining the security of your API keys and account credentials. You must not share your API keys publicly or with unauthorized parties.

3. Your Data

You retain full ownership of the analytics data you send to Agent Analytics. We store and process it solely to provide the service to you. We do not sell, share, or use your data for any other purpose.

Prohibited data: You must not send the following types of data to Agent Analytics:

Protected health information (PHI) — medical records, diagnoses, treatment information, or any data covered by HIPAA or equivalent regulations. Agent Analytics is not HIPAA-compliant and does not sign Business Associate Agreements (BAAs).
Financial account numbers — credit card numbers, bank account numbers, or other payment credentials.
Government-issued identifiers — Social Security numbers, passport numbers, driver's license numbers, or national ID numbers.
Children's personal data — any data from users known to be under 16 years of age, including data subject to COPPA.
Passwords or authentication secrets — plaintext passwords, API keys, or access tokens belonging to your users.

You are solely responsible for ensuring that the data you send complies with applicable laws and does not include any of the above categories. If we discover prohibited data has been sent to our platform, we reserve the right to delete it without notice.

4. Data Processing

If you collect analytics data from visitors located in the European Economic Area (EEA), our Data Processing Agreement (DPA) applies to your use of the service. The DPA is automatically incorporated into these Terms and governs how we process data on your behalf in compliance with GDPR.

5. Acceptable Use

You agree not to:

Use the service for any unlawful purpose
Attempt to gain unauthorized access to our systems
Send malicious, fraudulent, or abusive data
Exceed rate limits through intentional circumvention
Resell access to the service without our permission

6. Free and Paid Plans

The free tier includes limited events per month and limited data retention. Paid plans offer higher limits and longer retention. We reserve the right to modify plan limits with reasonable notice.

Paid subscriptions are billed through our payment processor (Lemon Squeezy). Refunds are handled on a case-by-case basis.

7. Service Availability

We strive to maintain high availability but do not guarantee 100% uptime. The service is provided "as is" and "as available". We are not liable for data loss, downtime, or service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, Agent Analytics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

9. Termination

You may stop using the service and delete your account at any time through the dashboard. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted in accordance with our data retention policy.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance of the new Terms. We will notify you of significant changes by updating the date at the top of this page.

11. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first.

12. Open Source

The core Agent Analytics tracking engine is open source under the MIT License. The hosted platform (app.agentanalytics.sh) includes additional proprietary features. These Terms apply to the hosted platform.
